The story that broke here on G4tv.com continues to develop, with ex-Infinity Ward execs Vince Zampella and Jason West filing a lawsuit against Activision. Adam Sessler and Patrick Klepek analyze what happened.

    Amid this chaos and strife is the perfect opportunity for another developer to attempt to give the COD franchise a real run for it's money for the fps crown. BF: Bad Company 2 has outstanding multi-player and I can only imagine BF3 is going to be in a great position to challenge the fps throne even further. The ensuing competition's real winners will be us gamers as they both compete to create the better product. Familiarity breeds contempt and I'm all too familiar with COD. That being said, I've played all the COD games to death and for the most part they are stellar products - I'm just enjoying the resurgence of the Battlefield franchise as a heavy hitter.

    I think West and Zampella have a snowball's chance in hell of gaining the rights to the trademark and property of the "Modern Warefare" brand. What I'd be more concerned about is the following:

    1) Showing and proving the dismissal from IW by Activision was legally suspect and wrong.
    2) Securing payment of owed funds from sales of CoD:MW2.
    3) Possibly using #1 as part of a bargaining chip to remove any "no competition" restrictions from their contract, since I'd figure they will want to continue working in the industry.

    if west and zampella actually make it to trial and win holy crap you will see things begin to crumble at activision, especially for howdy doody, he might not be the ceo for too much time after that if they lost MW. not to mention all the best of IW going to start a new studio with west and zampella. ohhhh all the melodrama

    I hope IW wins this, they could use a great start to a new publisher, such as the MW series. Plus i want to see Kotick and Activision go down for this, it would be a nice touch of karma for all they did with GH and THPS

    I agree with the developers, they deserve to have rights to modern warfare and the right to take it to another/their own developer. In addition they deserve royalty rights for the game as well. However, I do disagree that Activision should be barred from making a game set past the Vietnam war, they should have the right to make games that are set in a modern of futurisitic setting. Here is another however, Activision cannot use the modern warfare name or utilize the same setting/world created by the original developers. If Activision makes a new call of duty game set in a modern setting should be set in a different fictional world.

    Bobby Kotick needs to be strung-up, he's the biggest prick in gaming history, he wonders why he woke up on the death star this is the reason. No one likes him. If he was in my company i would fire his ass he's like a mean Peter Molyneux. The bastard floods the market with guitar hero games people dont want driving it into the ground. wants to charge more for the instruments, fires people probably dont know for sure yet but so he doesnt want to pay them. In the end he's a douche out for himself he's in it for the money which people will say yea duh but you should like your area of work, you shouldnt call the people that buy your stuff dumb, try to charge them more just cause you can and flood the market with un-wanted games. Even West and Zampella did end up doing something wrong for them to get fired, If i worked on the board at activison-blizzard i would fire him also because he's bad for business.

    After learning more about Activision and it's CEO, Bobby Kotick's, take on how he'd like to handle the video game industry, with profit apparently being the most important thing, it's hard to want to take Activision's side and much easier to believe what West and Zampella are claiming went down. I think that if Activision doesn't want to look worse and worse, they'll probably try to settle this, and quietly. And even if they don't, it's like others said, West and Zampella are obviously gonna try to make a new game, a new franchise, and with the success of Modern Warfare, I don't see why any company wouldn't want to be on board.

    I think any profit Activision is looking to protect is slowly being taken away the longer they drag this dog n' pony show out. The fans wont stand to see Infinity Ward drug through the mud.

    First of all, I would like to commend Patrick with the reporting of this major story. Normally when I hear news like this I usually don't care about what is going on. It's too early to speculate what is going to happen with lawsuit but I will say this: Activision is going to be hurting. They won't earn much on their next games and their reputation is damaged. Very few people will be supporting them, that is if anyone bothered to read this story unfold.

    Activision can keep MW name.Its only a name Vince and Jason can go on a to bigger and better games now that the strings have been cut.looking forward to there next title!

    Let's see what the contracts say, that is what this is ultimately all about. I can't believe Activision would terminate them without thinking they would walk away with the properties, but maybe they can.

    Talk about Press, they did this in the open I feel like everyone wants to see them break away and everyone does win regardless your going to see a lot more competition now not only that but other shooters have to now look out because a Modern Warfare and Call of Duty could come out on the same date I mean imagine that.

    Thanks for shedding some more light on the subject!

    The chaos is beautiful. Everyone likes watching the drama llama in the center of the room spitting in other people's faces. Right now I see it as children fighting over a toy. The money should go to the people who spent their blood, sweat, and tears in every hour making the game. Not the person who "came up with the idea".

    Knowing the whole story would be awesome though haha

    I don't believe this is even close to the end. First it's InfinityWard and Activision then it's BioWare and EA...Dare I say revolution?
