First Band Hero Tracks Revealed

Adam Levine, the singer/guitarist for Maroon 5 and coach on NBC's TV series The Voice, is suing Activision for the way his likeness was used in Band Hero, the publisher's family-friendly rhythm game released back in November 2009. Levine did a mo-cap performance for the game's lone Maroon 5 song, but he wasn't happy to later learn that his avatar could be made to sing any of the game's 60+ songs.

The lawsuit alleges that the video game publisher used Levine's name and likeness in the game in ways that overstep his original agreement, The Wrap reports. He's unhappy that his avatar can be made to sing any of the game's songs, including those which "would not have been chosen by him for recordings or performances."

Levine also takes issue with the fact that the game allows players to make his avatar sing with voices other than his own, "including female voices." The lawsuit is going after Activision for "fraudulent inducement, breach of contract, violation of the common-law right of publicity and unfair business acts or practices." Levine is seeking unspecified damages.

    This is the exact same lawsuit made by No Doubt (although they were decidedly more timely). But this does raise the question of why anyone would do motion capture for a product just to COMPLETELY IGNORE IT!

    The biggest point i have seen made here is that it's a waste of the courts time, to hell with both activision and maroon 5 both hav more money than they need and a horrible images tht cant be affected by anything done on "Band hero"

    @DOMIMI... don't need to know all the facts moron... its an AVATAR using his LIKENESS, the mocap was for his song only! Any other song you sing with him is just like using one of the other AVATARS!!!! And Avatar is a LIKENESS... and implies no voice inflection or tone or sound at all! Get your facts straight. Activision will unfortunatly win this one. He has no leg to stand on seeing that they changed the wording to Avatar. He needs to have some one read is contract for him, to him before he signs it. Guarantee after all the other mistakes activision chaned all the wording to AVATAR and LIKENESS.

    This is literally stupid! Another story of a millionaire artist who is so jaded by success that the idea that he is even ON a video game at all means jack squat to him. He should just be honored to be on the fricken game! Jesus Christ, I can sing a Devil Wears Prada song with Taylor Swift... you don't see her filing a law suit! Some one shut this retarded jack wagon up!

    I kind of agree with him about his avatar being able to sing in women's voices. That's pretty screwed up for a star who must maintain an image. I understand people know it's fake but it's outside his contact. It's worth a small lawsuit but depending on how much it can be taken overboard. Companies need to keep up with the contacts and not try and push product's by breaching the contracts.

    I find this to be disheartening. Not the suit -- its discussion. Mr. Levine is perfectly within his rights to uphold the contract he signed with Activision to use is likeness.When a contract is breached, the non-breaching party can and should act against the breaching party for reparations with respect to the breach. Mr. Levine isn't suing because he needs the money, but because he has a duty to uphold the terms of the contract (thus maintaining precedence for future contracts), and furthermore to protect his image as a professional artist. If he would not choose to perform a song as an artist, then why should his likeness be performing them?

    But seriously though, this is even more lame than the Napster/Metallica issue. Him whining like this is definitely going to effect his image way more than the game ever could

    To anyone who knows the definition behind "allege" it make's this case look like some whiny child trying to bring attention to himself by crying wolf. What a waste of the courts time.

    i don't think that its unfounded at all. its unspecified damages you don't know what he asking for maybe its a patch that prevents his avatar from doing all that stuff. if it was you that it was done to you would be doing the same thing if you found it offensive or damaging to your image. Famous peeps have rights too!
