Activision and Bobby Kotick may be headed to trial over Call Of Duty, as a Los Angeles Superior Court judge ruled that there were enough facts supporting the alleged defrauding of ex-Infinity Ward, now Respawn Entertainment developers, Jason West and Vincent Zampella, according to The Hollywood Reporter.
For those in the dark on the lawsuit, you can catch up with our Fall of Duty stories, but here's the short version:
- After an internal investigation that turned up alleged violations of insubordination and breaches of contract, Activision terminated West and Zampella.
- West and Zampella filed suit that their wrongful termination cost them over a hundred million dollars in CoD royalties. Activision countersued the pair, painting a picture of the duo being "Motivated by envy and personal greed..."
- Additionally, Activision added Electronic Arts as a co-defendent to their countersuit, claiming $400 million dollars in damages due to alleged tampering by EA's top executives.
- In March, Activision was found to have had sufficient claims against Electronic Arts.
So now with a fair amount of alleged dirt on everyone supported by the Superior Court, it's only going to make further revelations from these various lawsuits all the more interesting. That is, if this ever goes to trial. I can't imagine EA or Activision wanting a lot of the more gory details to ever go public, but considering what's at stake, a settlement's not going to come easy.

@UnArmedMan99-You obviously didnt read a word in this article. It was EA that tampered with infinity wards property and these two were fired for insubordination. There is no possible way that two developers could make four-hundred million dollars off of Modern Warfare 3. Plus EA hired these guys which shows that there are some connections between their insubordination and EA's tampering. Especially with Battle Field 3 coming out near MW3's release date and competing against it? EA needs to step their game up and stop acting like the New England Patriots and their 2007 spy-gating issue.

I will have to say that Activision has always been the kind to rip other people off and the two men in this discussion are just as much to blame as the next pair of guys that will do the same thing. So I know that the Call of Duty franchise will be collapsing in on itself and EA is going to take the lead for best first person with their Battlefield 3. The Call of Duty is long over do for a change anyways, so I recommend that if they bring out another one that they actually do their homework and create something to bring back its fans. But for me I will always be a battlefield fan,and thats because of the lack of hackers and the patching of glitches. the game play is more fun, more action based, and you need to work as a team. Now on the other hand Call of Duty is everyone running around just trying to see who shoots who.

too man west and zampella fans on here no wounder the good reasonable comments got so many thumbs down we all know deep inside west and zampella are wolves in sheep clothing there guilty of breach of contract aka talking with EA months before there contract was up which is definitely breach of contract so activision did do the right thing and investigate and suspend royalties till the investigation was through

Man..... if u ask me this whole situation is F!@#ed up. i doubt CoD3 will be better than Modern Warfare. i really do hope CoD3 is better and better than Modern Warfare 2. But the one who F'ed up the most is Activision. Did they really have to make a CoD game every year. Once West and Vampella were gone, it all went completely downhill. they said, "oh lets call it Black Ops and set it in year different settings with a Cold War environment". and so Black Ops became its failure and in my opinion so will Cod3. but with competing games like BF3 and Ace Combat Assault Horizon offering a better and different gameplay, i cant wait to see how CoD3 will fare up to them. specially since we have to pay for the full multiplayer Elite experience its offering. if the game is good, ill buy it. if paying for the Elite seems worth it, i may consider payin for that too. in addition, Activision paints a picture of envy and personal greed of West and Zampella, what about the picture they also are painting for us of their envy and personal greed? Cant they see that?

i hate west and Zampella after what they did allowing hackers to rule over MW2 i know activision has a bad rap but not all is bad ex IW refused to ban 90% of the hackers and reset the leaderboards plus their insubordnation allowed it to become the most pirated game in 2009 if u look @ the leader boards now look @ the top 10 in every gametype lobby u see they are responsible for putting patches out there!
Activision is just a publisher not a developer, So they dont release patches!
Its IW's responsibility im giving IW another chance with MW3, Of course there will be no West,Zampella to ruin it hopefuly
In all Activision has its downsides ya they price stuff like MP's a lil high but usually the Mp's are worth it in the end, But their ability to please the consumer never fails!!
Take Blizzard a developer under Activision for instance great customer support!!

There is a reason why they poop out a COD game once a year.......it's because after the second prestige the game is boring as hell. I care not about this lawsuit, I care not about these money grubbing suits that are involved, and quite frankly COD is over-rated. Most fan-boys would freak out over that statement but think about it honestly. Every other game that comes out in the series is never a sequel.....it's a ".5" version of the previous title sold to us at a 100% price point. Not innovative on it's predecessor EVER!!!!! It's buggy, hacked, unbalanced, and the community is FLOODED with angry kids who like to throw out racist and bigoted language on a regular basis. Let's take a break from Call of Duty so we can miss it; because as of now it's like a clingy ex-girlfriend you can't get rid of.

I am so excited about this proceeding. If this goes forward and West/Zampella are vindicated by the court system, we may see the entirety of CoD: MW3 pulled from production before they print the gold masters. According to what I understand, the duo who created the franchise do retain the rights to the Modern Warfare name, and the characters portrayed within (Price, Soap, etc.). I've been waiting for the day to come when Activision had to pay for their money-grubbing yearly installments in every franchise they own. Now that Guitar Hero and Tony Hawk have effectively burned themselves out with too many poor releases in a row, the CoD franchise is really all they have left. When that goes under all they have is crappy movie games and a douchebag CEO.

If Activision is "smart", they'd be trying to settle this out of court. Because the history behind this whole debacle is so rich, it'd more than likely end up in the mainstream news media for Call of Duty's popularity as a franchise, and give Activision quite the PR headache on their hands (more than the one they already got when the story was first broke by Patrick Klepek last year).

Instead of West and Zampella wasting their time on this matter they should just finish their god damn game already or least tell us what it is! You can get your revenge by shutting down Call of Duty with a better game. I mean seriously if this thing goes to trial there it is going to be a blood bath and it won't be pretty on either side. And no one will come out a winner in this fight.

I know this is unpopular opinion but I like activision more. they were the first major 3rd party developer when the left atari. As for EA they to be are snobby and think big of them selves. From what they did on the genesis having to feel the need to have a special cartage. Then getting licensed sports games and refusing to put them on the dreamcast was an ahole move. Sega sports games will better. I am sorry yes cod is popular and it may seem like the same game, but look at ea with there sports games, it now the era of DLC and they need to make the same exact game. And whats more evil is there hold on sport licenses.
