John Ryan McLaughlin has a problem with Bethesda's Elder Scrolls 4: Oblivion.  The former Navy pilot claims that the game caused grand mal seizures, and as a result he lost his flight status. According to McLaughlin's suit, he was playing the game, when its strobe lights gave him a "seizure for the first time in his life," causing pain and breaking a bone, as well as permanently grounding the pilot from the F18s he flew.

According to the filing:

"The product was so designed that it exceeded the upper acceptable limit of more than 3 flashes over a 1 second period, as well as acceptable spatial pattern and luminance flash limits. These risks were not made known to the plaintiff and/or an ordinary consumer prior to the time of purchase."

Should the suit succeed, the damages here could be astronomical for Bethesda. McLaughlin would like his medical bills paid, product liability damages, and punitive damages.

I'm neither a lawyer nor a doctor, but here's how I'd argue against this suit:

  • The plaintiff probably spent a lot of time playing Oblivion--it's a big game--and the fact that his seizure came about while he was playing was nothing more than coincidence.
  • Oblivion sold millions of copies, and yet this is the only complaint of this nature I've heard of. If the product is really defective, wouldn't there be other cases, all over the country?
  • The defendant was playing as an "Acrobat" class*, and that's weak and lame to start with.

    I have played every last drop of this game and have NEVER encountered anything like said "strobes." Not once. It's a total bs claim that will never hold up in court, and I'd be more than willing to be the first to take the stand and testify this. I'll be damned if I let some P.O.'d air force jerk bleed one of my favorite developers because he happened to have a seizure while playing a Oblivion. To the best of my knowledge, every video game has a disclaimer that says they are not responsible for any seizures or what have you that occur during gameplay. Therefore, it's his own damn fault. Should've set the controller down.

    I have played this game without sleeping a whole day. I also have vertigo, but nothing bad has ever happened to me from this game, only sore eyes.

    I have epilepsy, and never have had a seizure from a game. I'm calling bs on this. Plus Ive put in easly hundred hours into Oblivion and never had one. Seizure can hit any anything and point in some one's life. Plus there's a warning label on the box, in the box and usually when game starts

    So he had the seizure on the ground, while playing a video game and not moving, instead of having one way up high in the sky, while travelling hundreds of miles an hour? And he is mad about this? Smart move.

    thats why every video game ever made has that goofy litter warning with it. cant blame the game, i actually had epilepsy and had several seizures, not one from playing a video game though

    I have a friend that used to get seizures when he was younger. He hasn't had any in the past 5 years or so but he's prone to them in certain situations. He has been playing Oblivion for a few years off and on and nothing has happened to him. Seizures can be caused from any kind of rappid motion. This guy just randomly saw something on the screne that happened to stimulate him to have a seizure, wether it was the game or not that did so. He could of simply blinked or looked away from the screne and maybe he would of never had a seizure and stayed a pilot until he retired. Who knows the exact reason it happened but don't go blaming a video game that actually clearly states that it can cause seizures and expect to get something out of it. Maybe it was cause from all the years of flying F18's at high speeds but was just triggered while playing a game.

    also trying to sue a video game company for causing you seizures is like sueing them for causing you carpal tunnel. Almost everyone can get it regardless of if they play video games or not, but you wouldnt sue anyone for that because it's caused by actions you do everyday with your hands and seizues are essentually caused by a flaw in your jeans(not your pants) that either caused a malfuntion in your brain or heart that would make you prone to seizures. So it's no one fault and it never will be.

    Warnings have been out on games ever since the infamous pokemon episode aired and sent a few japanese kids to the hospital for seizures. I'm in the military and know that he probably didn't pay a cent for medicare treatment. And if all that happened was him being grounded, then the only money he lost was flight/pilot pay. Although, he will probably face a med board and be medically retired. But that medical retirement will give him med sep pay that could get up into the 50k range depending on how long he has been in the navy a well as medical care for his condition for the rest of his life.

    All games have the seizure fine print on the back and on the developer screen. This guy is hoping for a settlement deal, which Bethesda might give in to so this is off the blogs before Skyrim comes out. I feel bad about expecting the worst out of this Navy guy, but greed and bravery are not mutually exclusive.

    I think Skyrim now needs a character named McLaughlin that has a seizure whenever you talk to him. Just throwing it out there Bethesda.

    Wow... really? This guy must really be an easy target to any kind of bright light. I've had to raise the brightness of the game every time I played. Even on flat plasma screens, HD TV's and that weird 3D TV that goes good with Avatar the game.

    Any who, I got all 60 achievements and played all the missions (including all the DLC's thathave missions), and yet have I seen anything cause a seizure. Stephen is definitely right about this being the first of its case.

    What I'm wanting to ask is, why would a guy who gets a seizure from a game that's never had this kind of report be trying to fly a plane, jet, etc.

    This guy is known as, An Idiot.

    Just because it has a warning doesnt mean the product cant exceed legal limits. If there is a law about how many flashes can be presented within a certain time limit and Oblivion exceeded that limit theres absolutley no reason they cant be sued for it. Just because there is a disclaimer doesnt give the company free reign to do whatever they want.

    The only thing ''stupid'' here are you people freaking out *cough* DAZRILCAIDOZ act ur age.

    Aw poor flyboy got his wings clipped for having a defective body and needs someone to blame other than genetics... How cute. BTW, being prior service, the military would cover 100% of any medical bills incurred so what medical expenses is he suing for? Punitive damages? What because they found out he has seizures and kicked him off the jets? Sorry but it would have come about eventually anyways one way or another. Product liability damages? Wait is he also suing for personal stupidity damages for not bothering to read a warning? I smell rotten fish trying to scam through an already broken system...

    OMG are people this stupid wait... Let me rephrase that... IS THIS GUY STUPID!!!! I'm pretty sure that every game and every console you buy has -WARNING this game/console can cause dizziness,seizures, and other unusual reactions do to flashing lights or patterns- and it is in red so you know it is important to read. Every person that plays games or has a computer or electronic device knows this is common knowledge I mean even Animal Crossing for the DS has the warning and you don't do a whole lot in the game. If people don't start reading the warnings they are idiots and shouldn't even touch an eletronic device.

    Are world is doomed because of these people.

    Ok.... Im 30 and i have had GRAND MAL seizures since i was 5yrs and I have also played Oblivion and there is a warning label. But I have not had one seizure from the game. So what is he doing buying a game that clearly has the warning label.
