In a complaint filed today in Los Angeles Superior Court, Call of Duty: Modern Warfare and Modern Warfare 2 creators Jason West and Vince Zampella allege that Activision prepared to fire them while they were developing Modern Warfare 2. The suit contends that the pair's termination after the game's completion was part of Activision's game-plan.
According to the suit, West and Zampella were first promised that it was "impossible" for them to be fired, and that Activision would not release any games "associated with the Modern Warfare brand" or Call of Duty games "set in the post-Vietnam era, near future, or the distant future" without the consent of West and Zampella.
The filing contends that Activision then "strung West and Zampella along," until they completed Modern Warfare 2, then Activision "failed to honor its promises regarding West and Zampella's creative authority, then later used the conflict surrounding that failure as a pretext for firing West and Zampella" before the pair's bonuses were paid.
While Activision was supposedly "paying lip service" to West and Zampella's creative authority over the Modern Warfare franchise, the company was developing Modern Warfare and Call of Duty games secretly, without their permission, in violation of the agreements they had.
"While West and Zampella were still hard at work developing Modern Warfare 2," the complaint reads, "Activision began preparing to terminate them once the game was delivered."
According to the suit, part of Activision's motivations includes making the company "as attractive a merger partner as possible to Vivendi Games, with whom it was in the process of merging."
The potential payout for the complainants are huge here, including punishment payments (punitive damages), actual damages related to sales of Modern Warfare games, DLC, and other products, as well as the potential for ownership of the Modern Warfare franchise for games set post-Vietnam or in the near or distant future. So, basically, riches beyond the dreams of avarice are on the table, although no specific numbers are asked for in this complaint.
Every story, of course, has two sides. According to Activision, West and Zampella conspired with rival game publisher Electronic Arts to "derail" the Call of Duty franchise, and to basically steal Activision's intellectual property related to the Call of Duty series.
As of yet, Activision hasn't responded publicly to the filing, but when they do, we'll let you know. If you want to pore over some legal documents, check them out here.

Either way we'll probably get more CoD games. Hopefully West and Zampella can make a fresh start for CoD. Since Activision ruined CoD by doing what they did. No wonder why people say after MW2 its all just repeats. Tsk tsk Acti, just give West and Zampella rights to it.

to me mw2 was just a fun game to play never get boring as much as black ops......i play 2 matches of blacks then get bored idk y but black gets you bored quick.....I DONT Care WHAT PEOPLE SAY BUT MW2 WAS A GOOD GAME!

mw3 and activision could suck this meat........ EA take the opportunity now and don`t disappoint us release battlefield 3 as soon as possible and make sure its a game that will receive a 5 out of 5 stars

Ive never played battlefield games O.0 so i think ill try that since i have been plagued with Cod's disease but its still a " lets try and see" but from what ive heard its good =D

I hate Zampella and west i love IW but thos two are lil fibbers aka activision said nohing about keeping their royalties they said they suspended the royalties upon an investigation awhile back and west, zampella are still guildty of breaching their contract by conspiring with EA 6months b4 the incident and may i ask what call of duty game has activision secretly developed ??? black ops now get real everyone knows Activisions a publisher/producer not a devloper and everyone knows activisions been talking about a next MW game aka the joint developed one its no secret their just buying time
i hate west and Zampella because of the MW2 problems they allowed hackers to ruin the game nuke boosters jtags oh and did not patch the game when it should have been patched and allowed pirates to get a hold of the game early and not reseting leaderboards
if u play MW sometime look @ the global leaderboards at the top all hacked stats on the 360,ps3,Pc

@JWCamp You are right., Both companies are evil. EA has (to me) destroyed Mass Effect for me. (I did kind of like DA2 more then DA:O though, which is weird because it is so drastically different much like ME to ME2).
Anyway I think a lot of people's problem right now with Activision is this 'lesser of two evils' and Activision (when it comes to CoD games) is remembered for firing West and Zampella with apparently no evidence and in some weird scheme to save it self Bonus money.
Z and Dub have basically perfected the First Person Shooter game and it would be like Nintendo firing the guy who made Mario Brothers and then milked the hell out of the franchies without giving him anything. It's just disrespectful to the Gaming Gods.
And in no way am I a EA fan. EA destroyed my Command and Conquer.
But EA is better then Activision.

What I find hypocritical is that a lot of you are flaiming on Activision and showing love for EA. Do you realize that they both have the same goal? That goal is to take your money. EA doesn't care about you anymore than Activision does. They are both run by businessmen and businessmen have one goal.

It seems most of you are siding with West and Zampella. If Activision did perform a breech of contract then the courts will obviously see that in the evidence.

To me it sounds like they're both at fault. It seems like they both violated contracts at the same time in different ways. So to me, while I hope that Activision would just go away, It seems like there may be no clear winner here
