Call of Duty Lawsuit: Judge Rules EA Vs. Activision Case Will Go Forward

Call of Duty: Black Ops Multiplayer Reveal Hands-On

The "Fall of Duty" lawsuit that pits Electronic Arts and ex-Infinity Ward heads Jason West and Vince Zampella against game publisher Activision will continue, according to California Superior Court Judge Elihu Berle. Berle ruled that Activision provided enough evidence to allow its $400 million lawsuit against EA to go forward.

Activision's suit alleges that Zampella and West conspired with EA to help Battlefield: Bad Company 2 at the expense of Activision's Call of Duty: Modern Warfare 2. Jeff Brown, a spokesperson for EA, said that the publisher had never spoken to West and Zampella before their newly formed Respawn Studios signed up with its EA.



Calling Activision's case "conclusionary allegation," EA moved to have the suit thrown out. Judge Berle disagreed, basically ruling that although he wasn't speaking on the merits of the case, he does think there is enough information to let the the $400 million lawsuit proceed.

    activision ruined blizzard, they care more about out a half done game than a finished product

    EA has done way more for IP creators than Activision has ever had. Activision has had a profoundly negative impact on the industry, closings of multiple studios and running IPs into the ground. I'm not saying EA is innocent, but Activision is far from innocent as well.

    ea may not be the cleanest company, but compared to activision, they are saints. ea used to douces, but they have changed their ways and are working to better the industry, compared to activision who buy up companys and end up destroying them

    The more I read about EA, gives me great concern about this corporation, and their influence and involvements in the video game industry.

    Maybe its time they truly get what they honestly deserve, and that would be great news for everyone in this industry, and especially for us the consumer !
