
The Activision/ex-Infinity Ward lawsuit is heating up again. Activision has filed an amended cross-complaint in the legal case between Call of Duty publisher Activision and Call of Duty creators (and Infinity Ward co-founders) Jason West and Vince Zampella. In the complaint filed today in Los Angeles by Activision's representative, the company amended their initial counter-claim to add Electronic Arts, asserting that EA "conspired" with West and Zampella to "derail Activision's Call of Duty franchise, disrupt its Infinity Ward development studio, and inflict serious harm on the company." The suit alleges a systematic "pattern of deception" by EA to "hijack Activision's assets for personal greed and corporate gain."
Activision is seeking at least $400 million in damages from EA, West, Zampella and other parties, as well as a declaration that West and Zampella are prohibited from soliciting Activision employees, and an injunction against EA using any Activision confidential information.
According to Activision, the allegations in their pleading are "supported by documentary evidence supplied from West’s and Zampella’s own communications, from Electronic Arts’s own records and from the files of the talent agents and attorneys who conspired in the scheme to harm Activision."
The above-mentioned communications include emails sent from Seamus Blackley, an agent at CAA, who wrote: “I’m stoked about your options,” and, in an apparent reference to EA’s John Riccitiello, “JR cooks a mean BBQ. I think we could accomplish some interesting chaos.”

The suit categorizes talks between EA, West and their representatives as a "scheme," in which Electronic Arts "elicited and received confidential and proprietary Activision information from West and Zampella," and goes on to describe the founders of Infinity Ward as "small-minded executives almost obsessed by jealousy of other developers and the thought that another Activision game or studio might share their spotlight."
More on internal, Activision conflict detailed by the complaint:
"Motivated by envy and personal greed, West and Zampella went so far as to deliberately undermine the efforts of other developers within the Activision family and then lied about their conduct. On the same day that Treyarch released a video trailer promoting a follow-on product – a 'map' pack or 'downloadable content' – designed for players of Treyarch’s game Call of Duty: World at War, West and Zampella released a marketing video for Modern Warfare 2 with the purpose of hurting Treyarch’s and Activision’s marketing efforts...The real truth, however, was revealed by a series of text messages between West and an Infinity Ward employee contemporaneous with the video trailers’ release. The employee texted West that 'treyarch released their mp dlc video.' West responded: 'Super nice? We release our video? Crush and destroy with our video.' The employee answered: 'We already did. And . . . we already did.' West’s following comment: 'Nice.' Thus, West’s own words reveal his intentional strategy to 'crush and destroy' his fellow developers at Treyarch."

i never understood y treyarch was ever brought in in the first place. if it wasn't for infinity ward the Call of Duty games would of died a long time ago.if treyarch has proven anything it's that they can only make one kind of game.
i see treyarch as madden. yeah u keep coming out with a new game every year but what has really changed? where was the difference between W.a.W & BLACK OPS?
at least infinity ward tried to mix stuff up. there was a difference between M.W. & M.W.2. they added co-op and more of an online variety.

I'm sorry but even now Treyarch and Activision is profiting off of IW's creativity. Treyarch couldn't make a good shooter of their own and finally caved and copy/pasted everything IW did with the Modern Warfare games, and by most peoples estimation (including my own) did nothing but muck it up with the sham that is Black-Ops. Everyone I know is playing Black-ops merely "because" , Its to hard to go back to MW2 now, but many want to. I feel no sympathy for Activision who should be the last gaming company to cry foul about another companies "greed". Seen the state of Blizzard lately?

Activision couldn't make a good game to save their lives. Made all the more sickening by the fools who buy their products. Not that I'm a fan of EA I hope Act loses and gets countersued. They need to go away and make room for better developers.

Wow, corporate espionage and secret agendas, and million dollar lawsuits strewn about; maybe they could make that into a movie, instead of the madden curse.
That said: I don't really care which corporate fat-cat gets shafted, the whole truth won't be revealed, along with the motives of those involved, until long after the dust settles.

My head hurts from the pain of sheer stupidity and greed on the part of Activision.... Whats next? Are they going to get rid of Treyarch for talking about Christmas in an e-mail to someone from Epic games? Thank god I dont plan on giving them my money anytime soon.

I dont really see what activision has on EA here. I mean, Bobby Kotick doesnt care about us gamers, all he wants is $$$ and lots of $$$. SO if someone is threatening to overtake your company, or possibly talk about taking some ex-employees that hurt sales, is it really the best idea to sue them. This is America after all, free business opportunities for everyone. But then again, this is America, where anyone can sue anyone over how they looked at them/didnt look at them (or some funnier example if you can think of one, heck ill make it a contest).
I personally say, move over Activision, move over CoD, and move over Guitar Hero, EA is coming full throttle at you in a Deuce, and they are in Hot Pursuit of your "CoD fanboys". Its going to get all Vietnam up in here, and you will be handed your a$$es with a Death Spank... That is all.

Just when things were starting to calm down to the point where this lawsuit was an uncomfortable memory. If what's being read is true, this could really put Infinity Ward in an antagonizing light. And here we find EA's involved. This can't blow over soon enough, but seeing as it's a legal dispute between two or more companies with corporate ambitions, that won't happen any time soon.
