Over 1 Million More People Playing Call of Duty: Black Ops On 360 Than PS3

The Activision/ex-Infinity Ward lawsuit is heating up again. Activision has filed an amended cross-complaint in the legal case between Call of Duty publisher Activision and Call of Duty creators (and Infinity Ward co-founders) Jason West and Vince Zampella. In the complaint filed today in Los Angeles by Activision's representative, the company amended their initial counter-claim to add Electronic Arts, asserting that EA "conspired" with West and Zampella to "derail Activision's Call of Duty franchise, disrupt its Infinity Ward development studio, and inflict serious harm on the company." The suit alleges a systematic "pattern of deception" by EA to "hijack Activision's assets for personal greed and corporate gain."

Activision is seeking at least $400 million in damages from EA, West, Zampella and other parties, as well as a declaration that West and Zampella are prohibited from soliciting Activision employees, and an injunction against EA using any Activision confidential information.

According to Activision, the allegations in their pleading are "supported by documentary evidence supplied from West’s and Zampella’s own communications, from Electronic Arts’s own records and from the files of the talent agents and attorneys who conspired in the scheme to harm Activision."

The above-mentioned communications include emails sent from Seamus Blackley, an agent at CAA, who wrote: “I’m stoked about your options,” and, in an apparent reference to EA’s John Riccitiello, “JR cooks a mean BBQ. I think we could accomplish some interesting chaos.”

Activision Adds Electronic Arts To Infinity Ward Lawsuit

The suit categorizes talks between EA, West and their representatives as a "scheme," in which Electronic Arts "elicited and received confidential and proprietary Activision information from West and Zampella," and goes on to describe the founders of Infinity Ward as "small-minded executives almost obsessed by jealousy of other developers and the thought that another Activision game or studio might share their spotlight."

More on internal, Activision conflict detailed by the complaint:

"Motivated by envy and personal greed, West and Zampella went so far as to deliberately undermine the efforts of other developers within the Activision family and then lied about their conduct. On the same day that Treyarch released a video trailer promoting a follow-on product – a 'map' pack or 'downloadable content' – designed for players of Treyarch’s game Call of Duty: World at War, West and Zampella released a marketing video for Modern Warfare 2 with the purpose of hurting Treyarch’s and Activision’s marketing efforts...The real truth, however, was revealed by a series of text messages between West and an Infinity Ward employee contemporaneous with the video trailers’ release. The employee texted West that 'treyarch released their mp dlc video.' West responded: 'Super nice? We release our video? Crush and destroy with our video.' The employee answered: 'We already did. And . . . we already did.' West’s following comment: 'Nice.' Thus, West’s own words reveal his intentional strategy to 'crush and destroy' his fellow developers at Treyarch."

    What's annoying about this case is that both sides are trying to add a sinister twist to what actually happened.

    A big publisher scouting for talent? Normal

    A developer actively competing with another developer? Normal (although awkward when the other developer works with the same publisher and the same franchise)

    People choosing to work on something new instead of releasing another sequel? Normal

    Activision is going to have a hard time trying to prove that West and Zempella hurt Treyarch when Blops just earned them a billion dollars. What they should be trying to prove is that their company doesn't owe former employees their royalties - which is something I don't think they'll be able to do either.

    WOW!! A BBQ!! It's not illegal or in breach of contract to have friends outside of Activision. And them causing intereating chaos maybe they all planned on getting drunk and teepee'ing people's houses that wording could literally mean a thousand thing. It won't hold up. And the text messages are obviously edited severely. the BBQ won't hold in court but depending on the rest of the text messages that could go either way.

    This is why the only game under my tree is GOW Collection. All the new stuff is played. Maybe there is a Kincet also because I would never pay for that poop. But I want that poop.

    that seems kinda dirty, but who can really tell context in a text message?

    besides, that doesn't prove they did anything illegal.

    I think that it's naive to think there is a good guy or a bad guy in this. It appears that both sides are playing games (pun intended) with each other, the court system, and worst of all with us.

    I have to agree with keyatzin when I say, who cares which corporate fat cat gets richer or which one got shafted. Non of these guys are worried about the price of gas, so let them play their games if they want, don't expect me to get too fired up about it though.

    corporations are designed to only care about one thing guys and that's making more money for them and their stock holders. if you invest anymore emotional capital into a corporation than that wake up and go learn something about capitalism and the American way. i believe the course in any community college would be called macro-economics 101.

    ohhh wait i forgot that with the skyrocketing college tuition prices and the bank induced almost double dip recession we are in; most middle class families can't even afford junior colleges anymore. well, maybe they'll make a reality show about it one day.

    I can now honestly say I despise Activision. Hopefully IW can sort this crap out and move on with their lives, I really want to see what they make next.

    Are they really crying over a map pack? Hahaha oh and apparently because you bought THEIR company, they have to play nice with the rest of you the companies you bought out.....yeah that is just stupid. I used to think EA was terrible but every since the Activi$ion/Blizzard, I have lost respect for them. Every time I see their name in the news now it's just them trying to make someone else look bad for their own gain. Maybe they should join forces with Comca$t and Micro$oft , then they can all sit around counting the boat loads of money they rake in every year and strategize how they are gonna rip us all of next year. Ridiculous.....Activi$ion needs to grow up. Oh and did you see, they don't want anyone looking into their dirty laundry (an injunction against EA using any Activision confidential information) which is why this case will fail as well. Good luck in your money schemes Activi$ion...I guess WoW Cataclysm didn't do as good as you had hoped so now you gotta find a new way to make money lol

    At first on what happen with cod mw 2, I was really upset with how people try to find ways to cheat and messing up the game, and they later on release a crappy DLC for $15..Then I was hopping that Treyarch would make me happy.. But they did even a WORST job on porting the game too PS3..overall Activision dont give a crap PS3 users.. SO im 110% done playing COD series..

Oh boo freakin hoo, stop acting butt hurt because you think you're not making enough money, truth is that no one ever makes as much as they think they should. Your greed is showing, if you didn't know there Mr. Nodick... err.. Kotick. I mean 400mil, really? Why not just step it up another 100 so you can just say a cool 1/2 billion? Activision just needs to shut the hell up and go back to milking franchises and leave EA alone to do the same. It's only a matter of time before the roles are reversed and we'll all be saying the same thing. Round and round she goes... I think i'mma be sick.

    Honestly all of this makes me not like Activision even more. I was very upset with Activision when they dumped Brutal Legend and a few other games cuz Kotik said and I quote "These games can't be made into an annual franchise that we can keep making games year after year." Oh yeah and honestly has there been any real original IP's that have come from Activision? I mean if it wasn't for World of Warcraft I would be 100% boycotting Activision. I really wish Blizzard did not join with them. This lawsuit is proof that once again all major corporations care about is money. There are people that are without jobs and in need of money and we have a game company that has literally billions in there bank accounts and just because of the issues with IW and they went over to EA they have to find some way to screw over them out of money they don't really need or deserve. I have honestly lost all faith in Activision. Oh yeah and wasn't it not that long ago they added Bungie to there team for the next 10 years and we all know what kind of games they make. So in my opinion this is all for Activision to make a few more millions at the expense of them screwing over one of the most gifted developing teams in the gaming industry today and to take money out of there pockets and give all of us this unneeded drama when there is more important things in this world we need to worry about. Here is an idea Activision, seriously think about what you are doing to your image and pull your head out of your ass before you lose a serious fan base.

    Maybe if Activision wasn't hung up on this case Black ops might ended with a better results (my opinion) but no were stuck with a glitchy game (campaign at least, haven't played Multi much)
