First Look: Atomic Games' Breach

Atomic Games, the creators of Breach and Six Days in Fallujah, has close ties to the armed forces and is known for creating military grade tactical simulators as well as consumer first-person shooters, so you really shouldn't try to steal source code from them -- they'll totally catch you. This lesson that seems to have missed Justin D. May. The 20 year-old gamer is accused of having stolen Breach source code from Atomic at Pax 2010 a couple months ago, and this morning, May showed up for his first day in court to face the charges.

May reportedly downloaded about 14 MB of the game's code from a computer on the PAX 2010 show floor. He was arrested and charged by Boston Police, but later skipped his first hearing. This morning, he showed up in court and the judge agreed to release him on his own recognizance.

Suffolk County District Attorney Press Secretary Jake Wark told Joystiq that May will file a motion to dismiss the case at a June 27 hearing. Atomic estimates the theft as amounting to $6 million, which means if May's convicted, he's in a lot of trouble. He'd better hope the judge dismisses (or reduces) the charges.

David Tractenberg, a spokesperson for Atomic, said. "He said to myself and several other team members, after being caught, that it was not a big deal, he just really liked the game and wanted to play it with his friends."

What do you think? How big a deal was the alleged theft? Enough to do jail time? Or should everyone just relax -- it's just a video game, after all, and he just wanted to play it?
