Infinity Ward's Jason West And Vince Zampella File Lawsuit Against Activision

It looks like the former leadership of Infinity Ward are not going down without a fight. Former Infinity Ward CTO Jason West and president Vince Zampella have officially filed a lawsuit against Activision, according to a press release issued by their law firm, O'Melveny & Myers LLP.

According to the release, West and Zampella were terminated by Activision "weeks" before receiving royalties for Call of Duty: Modern Warfare 2. Activision purchased Infinity Ward in 2003.

"We were shocked by Activision's decision to terminate our contract," said West. "We poured our heart and soul into that company, building not only a world class development studio, but assembling a team we've been proud to work with for nearly a decade. We think the work we've done speaks for itself."

O'Melveny & Myers LLP attorney Robert Schwartz is suing Activision in pursuit of West and Zampella's right to compensation for the production and sales of Call of Duty: Modern Warfare 2 and the contractual rights allegedly granted to the duo to control "Modern Warfare-branded games." If seems West and Zampell may be fighting for the right to create Modern Warfare games outside Activision or to prevent Activision from creating Modern Warfare-branded games. Until we have more details, it's difficult to draw a specific conclusion.

Here's the full passage.

"Modern Warfare 2 is arguably one of the most successful games in history and together with Call of Duty, has generated more than $3 billion in sales for Activision. In addition, Activision seized control of the Infinity Ward studio, to which Activision had previously granted creative control over all Modern Warfare-branded games. The suit was filed to vindicate the rights of West and Zampella to be paid the compensation they have earned, as well as the contractual rights Activision granted to West and Zampella to control Modern Warfare-branded games."

"Activision has refused to honor the terms of its agreements and is intentionally flouting the fundamental public policy of this State (California) that employers must pay their employees what they have rightfully earned," said Schwartz in the release. "Instead of thanking, lauding, or just plain paying Jason and Vince for giving Activision the most successful entertainment product ever offered to the public, last month Activision hired lawyers to conduct a pretextual 'investigation' into unstated and unsubstantiated charges of 'insubordination' and 'breach of fiduciary duty,' which then became the grounds for their termination on Monday, March 1st."

According to the release, the suit is alleging "breach of contract, breach of the implied covenant of good faith and fair dealing, wrong termination in violation of public policy, and declaratory relief."

    ok breaking their contract or not. they already busted there ass on this game. i think there should be a fare compensation here for them. Activision is F'ed up. but the sad part is, its just business. I just got laid off today too =o( it sucks

    I have to admit I'd like to see them fight Activision, but it's hard just go in that direction. We still don't know the terms on which the two were fired.

    It could be Activision attempting to take full control of IW and MW in particular, but they also could have had valid reason to let the two go. Notice in their statement they do not say they were wrongfully fired, and they make no mention of the rational behind what transpired.

    I'd wait this one out before choosing a side. Who knows, this whole ordeal could end up being something Activision did in good faith, and the placeholders currently in charge will be changed to other IW members.

    Even though I am not a big fan of call of duty I am glad that they took action against activision. They have worked so hard to make one of the most beloved franchises in recent memory and DO NOT deserve to be treated this way. Heck making any game good or bad takes a lot of work and diligence. Making games that are so revered is almost impossible nowadays. Heck I cant even understand java let alone make anything close to a game. JASON AND VINCE, FIGHT ON!!!!!

    Not to seem like a downer but what are the odds of them winning this? Activision is prolly the biggest or one of the biggest maybe second only to UBisoft in terms of size.

    It's all about money, greed, and fortunes.. Didn't they make a game about that? Looks like Activision just wants somebody to do all the work, then come behind and steal it.. Didn't Bill Gates do that? I guess History does repeat's itself.

    Aha. This is what I suspected was under wraps yesterday. Just like Actilvision to try to squeeze more out of COD and when Modern Warfare proved to be a sucess try to squeeze that as well. Then fire the leadership at IW for refusing to budge and let them bastardize the franchise they clearly built. In one interview after the release of MW2, IW said that MW was the direction that they wanted to take the franchise after the original COD but COD2 was the compromise until MW. Activision thought modern warfare was too big a risk and wanted to stay in WWII. I wasn't in the room when this all went down but it sounds like the kind of heavy handed, strong armed tactics we have come to expect from cActivision. I know Bobby won't lose any sleep but no more Activision games for me.

    Wow and to think a few weeks ago I thought Activision was totally kick ass for calling EA out, screw that. I hope for the best of luck to Jason and Vince, and the whole of Infinity Ward in general.

    Funny how this comes up RIGHT after I watch Feedback haha.
    I really hope they win this because I feel Activision will just bastardize this series as they did with Guitar hero and Tony Hawk.
