Activision Answers No Doubt's Suit Over Band Hero

Band Hero Track List Revealed

Last month, we brought you the word that band No Doubt is suing Activision over its portrayal in music game Band Hero, claiming that the game "transformed No Doubt band members into a virtual karaoke circus act" by having them "sing, dance and perform over sixty songs" without getting their permission.

Activision has answered the charges thusly in a counter-claim filed on December 3:

Activision admits that it created and owns the "Band Hero" videogame that is part of Activision's flagship "Guitar Hero" videogame franchise, admits that Plaintiffs members' in-game characters {or "avatars"} which had been approved by Plaintiff are in "Band Hero" 'pursuant to a fully paid license agreement with Plaintiff, admits that certain users of "Band Hero" are able to "unlock" its members' in-game characters and can then choose to play songs performed by other artists using "unlocked" characters as part of their game-play, denies the truth of the remaining allegations set forth in Paragraph 2 and specifically denies any and all allegations of wrongdoing against Activision.

Activision's suit claims, basically, that No Doubt approved of the use of their likenesses in the game to sing other people's songs, then later didn't approve, but by then, it was too late: The game was already finished. In legalese:

Activision admits that although it is possible to program a videogame whereby particular in-game characters can only be selected when certain songs are played , Plaintiff first requested this only after the "Band Hero" programming was finalized , had been submitted to all of the U.S . console manufacturers for approval and had been approved for manufacture by most console manufacturers

I'm no lawyer, but the agreements/contracts attached to Activision's counter-suit that were apparently signed by No Doubt's members seem pretty clear cut to me. The moral of the story: Be careful what you sign, even if they're waving a lot of money in front of your face... either that or: Just accept that appearing as a character in a (Blank) Hero video game will make you look sort of cheesy when you play other artists songs. Console yourself with all the money they pay you.

    again i saw the post of people who route of this and it's true no doubt i bet ur doing this for fame or something to get ur names on tv or something please this is is so f*%# up i swear i hated no doubt any way before this and more after this so plz somebody kill no doubt

    why sholud i care i agree with guitar if u said yes to let the use u, u should have knew that u would be in diffrent place like the lead singer may be swicthed with the drumer so no dougt shut the heck up with ur carp already u people dont even make music any more.

    hey heres an idea, WHO CARES. its "no doubt". when was the last time i cared what song they sing. ive never been a fan of gwen, and i couldn't spot her band of monkeys if they fell out of the trees dead onto my car. (cept for gwen's little entourage of girls she had for a while. they were kinda hot). if we are lucky someone will use a program like garys mod to put their likenesses from the game into some animated bit on youtube.

    besides, this is Activision. they should be sued for kicking a dead horse. the kids who played this that i know of have the same complaint i do. every couple of months the music hero titles all have a new game. but rockband STILL has better looking graphics. and so far ALL of their music is backwards compatible. as long as rb3 sticks to this model, i foresee a grand future for music games in general. besides...anyone with half a gram of brain can tell you...A TURN TABLE IS NOT AN INSTRUMENT!

    Is it just me or is this stink a whole lot of nothing. How exactly does it in anyway hurt No Doubt to have video game avatars of themselves singing other people's songs. "They have us singing songs No Doubt would never play( I'm paraphrasing a quote from them)" So what.

    Is No Doubt playing those songs? No. Do fans of No Doubt think that No Doubt loses there hiop outsider status? No. (Generally because you can't release a slew of Pop albums and then a Pop/hip-hop solo album and still claim to be underground or indie).

    I think No Doubt just needed something to get their names in the papers. And this is the best that can come up with. Now I ain't no holla back girl either (although my wife would disagree) but this suit makes No Doubt come off as dumb and rather lame.

    No one playing this game is looking for authenticity or reverance to the bands with in. This isn't a No Doubt specific game like Beatles: Rock Band or Guitar hero: Metallica. This is Band Hero a game that has received little mention beyond this.

    No Doubt. Take your own advice and simply Don't Speak.

    Has anyone wondered if this is just ploy by No Doubt to retain face? It is hard to believe that No Doubts lawyers did not say:, we signed a contract, we cant win. So there must be some sort of benefit to No Doubt since there is a cost to them.

    Heres a question; What if they did it to the beatles? What if they made them sing songs like MC Hammer? I bet everyones tune in here would be the exact opposite. I personally think its retarded you can have a different band sing songs other than what they made but hey, im just a normal person wtf do i know?

    I have lost all respect for No Doubt after this. What a bunch of backstabbing, juvenile, cry babies. Get over it you stuck up tools, you signed a contract. It is over, end of story. Go back to spitting on everyone who isn't rich like you and suing when something doesn't go your way. Pathetic.

    'Selling out' only have meaning if it affects the artistic integrity of the band. If the band starts to write 'cheese' just because they know a formula will sell then its bad. Bands that continue to innovate and make great new music...but just happen to get rich, and get money thrown at them for action figure licenses...who cares.

    Since they can patch the content, they're obligated to accommodate No Doubt. Either they release an update that removes the band or they pay damages (or settle). FWIW I am a lawyer.
