One of the major hazards of playing games online is that you oftentimes have to deal with some pretty obnoxious folks saying some pretty obnoxious things. Muting options obviously help with this, but they can really only do so much. And while we often hear about the people forced to listen to someone’s inane ramblings, we don’t normally hear about the players whose comments make multiplayer gaming a frequently frustrating experience. Enter one Erik Estavillo.
As GamePolitics reports, Sony recently banned Estavillo’s PlayStation Network access for comments he made while playing Insomniac Games’ FPS Resistance: Fall of Man. Naturally, Estavillo believes this to be a violation of his First Amendment right, which is why he has brought suit against Sony for damages incurred as a result of his banning. (Sadly, the brief doesn’t specify what Estavillo said to cause the banning, but that’s hardly surprising, considering Estavillo filed the suit himself, and doesn’t appear to have legal representation).
Estavillo claims that the banning, combined with his various medical conditions, has caused him $55,000 worth of pain and suffering. According to the brief, Estavillo suffers from Obsessive-Compulsive Disorder, Panic Disorder, depression, Crohn’s Disease and, most importantly, agoraphobia. You see, because of his debilitating fear of crowds, PSN is the “only way the plaintiff can truly socialize with other people.” Well, now we’re getting somewhere.
And if the irreparable personal suffering wasn’t enough, Estavillo is also accusing Sony of stealing money from users by blocking access to PSN cash acquired via PSN Redeem Cards once users have been banned from the service. Sadly, Sony’s PSN user agreement clearly states, “Upon termination for any reason, you will not receive a refund for items, value accumulated on in-game items or any unused balance in your wallet except as expressly provided in this Agreement and to the extent permitted by applicable law.”
As far as whether Sony was within its rights to issue the banning in the first place, a quick glance at the Resistance online user agreement pretty much says it all. “If you violate this Agreement in any manner, SCEA may at its discretion and without notice to you temporarily or permanently block your account and/or reset your stats and/or rankings in this game and any related games.”
Estavillo also alleges that because gamers under 17 years of age are able to play the game online, despite the game’s Mature rating, the entire PSN user agreement system should be deemed nonbinding. This obviously has nothing to do with his particular case, and even if it did, Sony’s user agreement takes care of this issue as well.
Clearly, Estavillo should have focused all of his effort on the pain and suffering claim. Sure it would require significant medical examination to prove, but it’s the only argument of the bunch that even comes close to holding a drop of water. Of course, if Estavillo’s comments were in fact of the inflammatory variety, the whole case is shot anyway. I’ll keep you posted on how this whole thing turns out.

Wow, I've heard some pretty vile stuff online. I wonder what it takes to actually get banned.
And I'm not an American lawyer (Canadian), but I expect that the First Amendment covers government imposed limitations on freedom of speech. It shouldn't prevent a company like Sony form restricting use of its services.
I am curious what the rules are for awarding costs in garbage lawsuits. I like our system where if you lose, you can have to pay the other side's legal costs. I'm guessing Sony's lawyers don't come cheap.
My guess is that Sony will apply enough pressure that this will go away. I'd love to see the statement of defense, though.

Most of you miss the point here. It is SONY's discretion to stop someone from speaking on their server or network. It wasn't owned by the public, and some kind of government enforcement didn't infringe on his rights.
It would be the same if I asked you to leave my house because I didn't like what you were saying or if I told you to stop talking while we were in my car.
As much as it is his right to act like a fool on the internet, it is Sony's right to tell him to pipe down on their network. I hate when anyone is quieted down, but there is no way he is going to win this.

Its about time someone started banning people who abuse their rights online where they cant get decked in the mouth for the things they say.
If only MS took this kind of action, but of course this is because everytime they actually ban someone its one less paid subscription.
Its the guys own fault no matter what was said, either keep your mouth shut or dont play online, theres mute functions for a reason and kick/ban options in most games to get rid of the annoying children/adults that play most competitive games.
All the possible courses of action that COULD have been taken by this fool along with all the rules clearly stated in the TOS rip apart any possible case this person has, personal responsibility need to come into play at some point in this generation and its about time people started to realize it.

I think Mircosoft should follow their example and get rid of all of the ranting, whining, crybaby 12-year-olds on XBL. I get tired of getting online and hearing people talk at all. I always just mute everyone in the game. Also he did agree when he signed up and everytime he ran an update.
Speaking of muting people does anyone know if you can mute players on BF 1943 (PS3 specifically)?

i think this guy has a chance( even though he is bat s#%t crazy). Big companies like ms and sony respond to these kind of issues by just settling and giving money to delusional jerks like this one. as lame as it sounds he will probably come out on top. nothing will change granted but thats the point of paying these kind of people off, especialy sense this has gone public.

I guess when the founding fathers thought of freedom of speech they didn't know that every square inch of this country both actual land and hyper space would be privately owned and the 1st Amendment would pretty much be deemed useless unless you're standing on the 1% of public land actually still owned by the govt. We need to have the bigger discussion about contracts and what they can actually bind a person too, in other words you can't sign away your rights, and companies shouldn't be able to demand that your rights be sacrificed in order for you to buy their product. Don't give me that "then don't buy their product" crap either. I think any company or person that demands your constitutional rights be relinquished should not be considered American and should be taxed as if they are from foreign country operating in our borders. If you don't want to give the customers their constitutional rights then you don't care about our country, you just care about making money, and companies need to be more than that in this country.

This nutball is crazy, Sony and MS have terms of agreement, that states you can and will be banned for offensive behavior, verbal abuse and so on.
