PlayStation 3 User Sues Sony After Being Banned For Comments Made While Playing Resistance: Fall of Man

One of the major hazards of playing games online is that you oftentimes have to deal with some pretty obnoxious folks saying some pretty obnoxious things. Muting options obviously help with this, but they can really only do so much. And while we often hear about the people forced to listen to someone’s inane ramblings, we don’t normally hear about the players whose comments make multiplayer gaming a frequently frustrating experience. Enter one Erik Estavillo.

As GamePolitics reports, Sony recently banned Estavillo’s PlayStation Network access for comments he made while playing Insomniac Games’ FPS Resistance: Fall of Man. Naturally, Estavillo believes this to be a violation of his First Amendment right, which is why he has brought suit against Sony for damages incurred as a result of his banning. (Sadly, the brief doesn’t specify what Estavillo said to cause the banning, but that’s hardly surprising, considering Estavillo filed the suit himself, and doesn’t appear to have legal representation).

Estavillo claims that the banning, combined with his various medical conditions, has caused him $55,000 worth of pain and suffering. According to the brief, Estavillo suffers from Obsessive-Compulsive Disorder, Panic Disorder, depression, Crohn’s Disease and, most importantly, agoraphobia. You see, because of his debilitating fear of crowds, PSN is the “only way the plaintiff can truly socialize with other people.” Well, now we’re getting somewhere.

And if the irreparable personal suffering wasn’t enough, Estavillo is also accusing Sony of stealing money from users by blocking access to PSN cash acquired via PSN Redeem Cards once users have been banned from the service. Sadly, Sony’s PSN user agreement clearly states, “Upon termination for any reason, you will not receive a refund for items, value accumulated on in-game items or any unused balance in your wallet except as expressly provided in this Agreement and to the extent permitted by applicable law.”

As far as whether Sony was within its rights to issue the banning in the first place, a quick glance at the Resistance online user agreement pretty much says it all. “If you violate this Agreement in any manner, SCEA may at its discretion and without notice to you temporarily or permanently block your account and/or reset your stats and/or rankings in this game and any related games.”

Estavillo also alleges that because gamers under 17 years of age are able to play the game online, despite the game’s Mature rating, the entire PSN user agreement system should be deemed nonbinding. This obviously has nothing to do with his particular case, and even if it did, Sony’s user agreement takes care of this issue as well.

Clearly, Estavillo should have focused all of his effort on the pain and suffering claim. Sure it would require significant medical examination to prove, but it’s the only argument of the bunch that even comes close to holding a drop of water. Of course, if Estavillo’s comments were in fact of the inflammatory variety, the whole case is shot anyway. I’ll keep you posted on how this whole thing turns out.

    WTH!? you know he gonna lose this case. Sony isn't gonna settle. If you had read the Term of Agreement, you wouldn't be in the fodder. And the Mod does have the right. However, I've seen them ban people not only for first offender, but for repeated offender.

    However, we do have to applaud Sony for being the only company to ban someone from the PS3. We're on here to play. Any profanity is not an expression of Freedom, but an expression of your idiocy level.

    BTW, 1st Amendment only cover if you're in the public area or you hosted an public server. Sony own the forum and the Network, so they can ban whoever violate the ToA. IF YOU DISAGREE with what Sony does, then you should take class on Business Venture and study up on what is known as a Contract. When you agree, you're liable.

    and one more thing, Don't moan and whine if you're suddenly banned and you had 30 buck on PSN. It your fault for not being more mature and show your intellect instead of showing how uneducated you are. If you own the ps3, I'LL NATURALLY ASSUME you have some degree of education to some degree, right? Or are you gonna show us how uneducated you are on the forum, gameplay, and HOME? Time to Grow up, nothing is free anymore.

    The kids biggest mistake was demanding a Jury on all issues. No one likes going to court for jury duty, and no one likes dealing with punks who throw fits when they can't play their games. Since this isn't really important news in any way it's very unlikely to complicate the jury selection process (no one will go in biased), and as soon as this unfolds the jury will be pissed that they are there dealing with this kid.

    "Signing away our rights?" Are you kidding me?

    I'll make a comparison:

    When you go to any public school, you agree not to use obscenity. They can punish you for that, right? After a certain point, you can get expelled, right? Even for just talking? Yes, you can.

    When you sign a contract, you're not giving away your rights. You're agreeing not to speak a certain way when utilizing their product. You can say whatever you want, but they have the right to not allow you to use that product. Go ahead and say it. You won't be arrested. You just won't be able to play that game.

    When you come to my home, I enforce certain rules. If you speak to me rudely, I can throw you out of my home.

    When you enter a casino, they have the right to throw you out for any reason they see fit.

    The bottom line is:YOU DON'T HAVE THE RIGHT TO VIOLATE OTHER PEOPLE'S RIGHTS! That's what he did. He joined a community in which everyone agreed to behave a certain way. When he decided to behave a DIFFERENT way, the company saw fit to ban him. He still has the right to bahave that way; he just can't do it on that network.

    Bottom line is: You're not signing away your rights. Get over it.

    I'm sick of people using the first amendment argument. I wholeheartedly support the first amendment, but you have to understand it to invoke its use. It basically means you can say whatever you want and the government won't stop you. But posting on sites or third party media, they CAN block you, because you are using their tools to do so. You are using their site or name to spread your word, but it reflects on that site as well.

    Basically, you can say whatever you want, but I don't have to give you MY microphone to say it.

    Anyway, your question was what rules supreme, Sonys' T.O.S or the Constitution? Due to this mentally challenged individual who could simply just create a new account, i do feel bad for him if he actually does have that mental illness. I happen to know a handful of, "hermits", if you will, that ONLY PLAY WORLD OF WARCRAFT XBOX/PS3 LIVE all day and thats their lively hood, its upsetting actually.

    However, the "when in rome" concept must be brought into light here. You accept an agreement with SONY that you will adhere to their rules...yes, the Constitution is definitely more powerful i need not stress that, however, you broke sonys rules and thats why sony banned you. Perhaps had he not broken whatever probably stupid rule it was that he broke he wouldnt be going through all this court nonsense which probably wont get resolved until 2017 anyway.

    If the kids telling the truth and ps3 online is his only social circle, then please re-instate his account. I mean come on, thats all he does(supposedly). So if it is, help him out cuz that wouldnt be right.

    I'm not saying he'll get anything(hell if he was cursing people out he deserves the ban) but I'm just saying his condition was mis-described. His disease is not merely fear of crowds(strangers or otherwise) it's a fear of unfamiliar surroundings which, depending on the severity of the situation could make what might be a suggestion said multiple times(haven't read every comment) of "just switch to another service" near impossible.
    I'm not gonna pull any of the "First Amendment" crap that alot of people are saying but, pertaining to his illness, and whether or not the Mod was working on word alone for the ban. This guy might get a settlement and his account back.
    Look at it from Sony's PoV, you all know what news stations like Fox and them did with the "sex scene" in Mass Effect(which was a description from a person who'd never seen or played the game), think of how badly it'll look when "Sony descriminates against autistics by barring them from service" or some crap.
    Not saying he'll get money, not saying he deserves it. I have no personal experience with the PSN, it's Mods or Resistance's community. I'm just saying that Sony has a deep pocket and keeping this out of the public spotlight with a settlement is probably what they'll do.

    PSN and XBL can do whatever they want if it falls under their user agreement. I personally support sony here as there are many times when i am on XBL and get offended by someone's lose mouth, especially on the racists end. Although i do not know what the guy said, it must of been worthy of being banned. and Bo_8 , yes you can not call the president a rapist, and that is covered under the 1st , under slander.

    The First Amendment does not absolve anyone from personal responsibilities, nor exempt him/her from the consequences. Anybody can say what he/she wants, but if you are irresponsible with what you say or write you will have to suffer the aftermath, legally and/or morally.

    Let say you called the President of the United States a rapist (obviously an extreme example), would you expect to defend yourself with the First Amendment? Sure you have the freedom to express this, but this certainly would be irresponsible.

    Most user agreements are not trying to take away any of our rights (trust me, the lawyers make sure of this), but to make sure everyone's playing on a level field.

    I wish more people would understand the spirit of the First Amendment when our great forefathers created it and not abuse it because it suits them.

    This is hilarious, this must be the same guy from last week that the swat team had to investigate his home because a neighbor heard screaming and yelling cause the guy was playing a video game.

    Anywho, User Agreements and Terms of Service are always funny in that it always protects the business, website, ect. I just found out several months ago I was violating Terms of Service for Google while in middle and high school, go figure! He must said something to the wrong person or people to get himself banned from PSN. And another thing, I'm an avid video game fan and I believe that no self-respecting Neurologist or Psycologist or whatever would reckomend anyone with a mental issue to "medicate" themselves with fantasy-envoking, war-simulating, turtle- jumping, ect video games.
