Man In Trouble For Craigslist Posts

J.P. Weichel, age 40, of Loveland, CO is in a whole heap of trouble with the law for posting disparaging comments about his ex-girlfriend and her lawyer on Craigslist's "Rants and Rave" section.

District Attorney, Larry Abrahamson has charged Mr. Weichel with two counts of criminal libel, based on a 1800's era state law "that can put people in jail for the content of their speech or writing."

Court records show that Mr. Weichel alleged in his posts that his then-girlfriend provided sexual acts to her lawyer in exchange for legal services.



As libel is usually a civil case, those seeking it as a criminal case could be setting a "chilling" precedent on free speech in Colorado, especially as it pertains to the Internet.

Steve Zansberg, an attorney who specializes in First Amendment law, feels Colorado's law which allowed prosecutors to charge Mr. Weichel on libel is "outdated and unclear about stating opinions, and is written in such a way that [even] dead people could be victims of criminal libel."

Criminal libel is punishable by up to 18 months in prison.

The MySpace suicide case in California found the mother, Lori Drew, guilty of three misdemeanor counts. And that's just one of many that have sprouted up in recent years.

In the scheme of things, as the Internet is relatively new and there aren't federal cyber slander laws and statutes, what is there to be done? U.S. attorneys and prosecutors are left with previous cases that have gone to court to use as examples to try and punish bad people.

It's obvious now, that going online and talking about someone you don't like, even if you think it's just harmless trash talk, could have serious consequences.

It's the freaking internet...heck, its freaking craigslist. Give it a break.

I mean seriously, if people are OMG THIS IS SERIOUS BUSINESS and its on the internet thats about as good as using Wikipedia as a source for a paper.

i agree that it's a frivolous lawsuit but this guy will be sued. let this be a lesson to all you guys , don't screw with lawyers...

...whats funny...theres a million old laws like this...and a pissed off lawyer...will bust them out on ya....thou itll get droped...itll still be a pain to deal with...man can argu they didnt have internet back then so that law wouldnt pretain to it...seeing that...if the law sticks...then we might aswell file lawsuits aginst obama and mccain..

Wow so people can't vetn out anger anymore. I swear society is becoming real p**sy's lately. Complaining about hurt feelings and such it is just words. Yet people can't take it.

this is a dumb out-dated law. but comparing slandering a lawyer to the cohorst suicide of a teenager, that is a big stretch... I'm all for freedom of speech, but everyone seems to forget that the freedom of speech amendment has it's own limitations. You can say what ever you want unless it causes harm to another person, the old "you can't scream fire in a crowded theatre" rule.

Maybe its the people that can't handle life without spouting a bunch of negative crap like hurt little children are the one's who are "p**sy's" as you put it. Since when do we have to let people spout hatred and lies because they're not happy that their girlfriend left them. Trust me, the First Amendment is not around to permit people to spread false rumors because their feelings have been hurt.

thats true but for this case specifically, it was Crag's List... its not like it was some big professional setting where this guy was trying to get the lawyer fired for suspecting him to be sleeping with his ex girlfriend (assuming that he never saw them together, since it never mentioned it for sure).

Based on the quoted text of that utdated law, he should be found not guilty anyways.

didn't see this detail in the story but did they find out whether or not his allegations were founded? if his ex was giving sexual favors to his lawyer then there really isn't a case. it would be a blast to be a fly on the wall in this courtroom.

THIS IS A BUNK LAWSUIT.....TELL ME HOW THAT LADY WAS HARMED BY HIM VENTING ON CL?....WAS SHE PHYSICALLY HURT?DID SHE LOSE HER JOB?...NO!.....SO TO THE LAWYER AND EX-GIRLFRIEND....GET OVER IT!

if the woman and the lawyer were "together" at any point while she received legal council this will get thrown out. this seems to be a case of the misdirected vent i leave this kind of speculative smack talk to private blogs and bathroom walls.
