The John Facenda Estate sued the NFL in 2006 for illegaly allowing EA to use the late, great sports announcer's voice in a Madden 2006 promotion.
Facenda is the famous voice of the NFL Films series of archival games footage. He passed away in 1984 but you'd probably still recognize the voice, even if you don't follow football.
With the NFL hoping to settle before it went to court, the case is only just now making its way to court and it appears that the 22 minute film's purpose will determine the decision. Was it intended as a documentary about the making of the game or as a commercial for the game? Only lots of time and a long series of judges will decide.
