Update: "RichardGaywood" Ban

Cheers to Kotaku for contacting Xbox LIVE about the recent ban of Richard Gaywood's gamertag "RichardGaywood." After proving that it is his bona fide legal name, Xbox has said they will not be reinstating his gamertag. Seriously?

Here's what Xbox had to say:
We want the Xbox LIVE community to have the freedom to express themselves, but we also have a responsibility to create an inclusive, safe environment. While it may be clear to some that Gaywood is a legitimate surname, it may not be obvious to other Xbox LIVE members. In this case, a complaint was filed by a member of the community, requiring the Xbox LIVE team to examine the gamertag within the context of the Xbox LIVE Terms of Use. Based on the these guidelines, it was necessary for the gamertag to change."

So, they followed the letter of their own law and the crappiest part is there's probably no legal recourse Gaywood can take, aside from a discrimination suit but, that's a little loose, in part because Microsoft covered their booty so well in the terms and conditions up front and it's basically a private club.

Xbox is concerned about younger players being exposed to unsavory tags in the system. But if that's really true, what about these actual gamertags: "jesus is gay," "POT DLVRE GUY," "MolestedDolphin," and "F**k B**ches" except the asterisks are the actual letters. We censored it because it's f***ing offensive, way more offensive than a guy's actual name could ever be. FAIL!
