Class Action Suit Filed Against 'Halo 3'

Posted by Stephen Johnson - Wednesday, November 21, 2007 12:01 PM

In a very informal poll conducted around G4's office, 0% of respondents reported that Halo 3 bricked their 360, but apparently, we got lucky.

Gossip website TMZ is, for some reason, reporting that a class action lawsuit was filed in Federal Court, which claims Halo 3 is causing major problems for 360s.

Randy Nunez alleges that when he used the game on his console, it would "crash, freeze, or lock up" while running.

So he filed a class-action suit. For five million bucks.

In an unrelated side note, the editors of TMZ, a website that hosts literally thousands of hours of cellphone footage of vapid actresses walking out of restaraunts, thinks you are a nerd.

I wish I could've been a fly on the wall when Randy Nunez was discussing this suit with his lawyer.

"So, Randy, anything new going on in your life?"

"Aw, yeah, life is HORRIBLE!"

"Why, what is wrong Randy?"

"Well, I've got this xbox, right? And I'm playing Halo, and just when I'm about to teabag this kid, BLAM!"

"You teabagged a child? Randy, this could be a serious issue. Don't you ever watch 'To Catch a Preditor?"

"Naw man, my 360 crashed! That thing cost me like $400 or something!"

"Well...that's...um...terrib le..."

Posted by tedcwilliams - Wednesday, November 21, 2007 12:58 PM

"Yeah, those Microsoft bastards broke my system with their game! Games do that, you know..."

"Microsoft makes video games? Yowza, I hit the jackpot!"

"What did you say?"

"Nothing. Say Randy, I think you should sue Microsoft for hurting you so badly."

"Yeah, you're right! We should! I'm going to sue them for like a billion bucks!"

"Whoa whoa Randy. Let's not talk crazy. Microsoft's a big company, but they won't take a suit like that seriously. Lower the bar a little..."

"Like...5 million?"

"Now we're talking."

$5 million?

The most he's gonna get is a new Xbox with Halo 3!

Posted by PRmykey327 - Wednesday, November 21, 2007 1:26 PM

you can make a lawsuit about anything these days,.."how much do you think i can get if made a law suit about the ps3 sucking"?

Posted by liquisoft - Wednesday, November 21, 2007 1:29 PM

My buddy's 360 bricked during Gears of War. Halo3 runs just fine for him, after MS fixed his system.

Posted by SirCitadel - Wednesday, November 21, 2007 1:30 PM

yeah, where did he get 5 million from? the frustration of not being able to play videogames isnt worth 7 digits. and maybe its not halo... maybe its the 360.

Posted by PaNfOoT - Wednesday, November 21, 2007 1:40 PM

What a moron.

Posted by marofox - Wednesday, November 21, 2007 2:11 PM

I'm under the impression that frequent use of the 360 as well as keeping it in bad places (like on the carpet) causes the Red Ring of Death, as oppose to specific games. Unless he has good evidence of Halo 3 crashing his system as well as a majority of all other 360s out there, then this case holds water. Since I doubt this is the case, just give the whiny SOB a new copy of Halo 3 or a refurbished 360 (depending on whether the problem lies in the game or the console) to shut him up.

Posted by deathsdelivery - Wednesday, November 21, 2007 2:14 PM

Its not Halo 3, its the crappy hardware.

Posted by sps73 - Wednesday, November 21, 2007 2:21 PM

Posted by Archonic20 - Wednesday, November 21, 2007 2:37 PM

Another lazy bastard trying to get out of working for the rest of his life like a normal person.

MS will at MOST, compensate for the damages to the xbox and give him a new game.

5 million dollars though? If any judge rules in favor of that, the justice system will officially be put into its coffin and on its way to its final resting spot.

The viewing will be held on Saturday at 3pm at your local court house. :P

Posted by viewdrix - Wednesday, November 21, 2007 3:31 PM

5 million? Probably a bit high.

But it's a true claim.

Posted by Proof87 - Wednesday, November 21, 2007 3:33 PM

Here are my theories.

1. This guy is looking for cash and is not an actual gamer.

2. This guy is a retarded idiot that never came to the conclusion that is disc is scratched.

3. This guy is so stupid he actually thinks this will go to court for more that 2 minutes.

Posted by Proof87 - Wednesday, November 21, 2007 3:39 PM

LOL! Hey Everyone! I'm gonna sue Sony for releasing 2 crappy systems that are called PS3 and PSP! I predict the case will reach a verdict in 30 seconds saying im stupid for actually thinking the court will go in my favor!

Posted by capthavic - Wednesday, November 21, 2007 3:44 PM

@Proof87

I'm willing to bet it's a combo of #1 and that he has a modded console. Whatever the case he's retarded if he thinks he has a chance of winning.

Posted by TheKei - Wednesday, November 21, 2007 7:21 PM

The guy's an idiot for buying a faulty system in the first place.

Posted by gamesta - Wednesday, November 21, 2007 7:28 PM

Now I don't like Halo, 360 or even Msoft, but this guy is a first class douche bag.

What is funny is that Geometry Wars bricked my first 360...If I only knew it was a 5 mil ticket I would have cashed it in. But oh ya im not a effn idiot.

Posted by Ps3nation - Thursday, November 22, 2007 6:13 AM

The 360 is a defective system.

Posted by Archonic20 - Thursday, November 22, 2007 8:45 AM

I don't know anyone who has a system that has died. I know a lot of people with 360s. They all have the fan kits and they don't run their 360 for more than a few hours at a time. Maybe that has something to do with it..? Maybe not. Who knows.

Posted by EducatingEric - Thursday, November 22, 2007 10:20 AM

let's all sue over first world problems! you can't play halo 3? JESUS CHRIST SOMEONE GET THIS MAN ON LIFE SUPPORT HOW WILL HE SURVIVE. god forbid anything absolutely terrible happens to these people, which i will being praying does.

Hahahah that idiot probaly got his off ebay!

Posted by SonicNiGHT - Friday, November 23, 2007 3:57 AM

My 360 doesn't make toast...maybe I should sue them too... (lol)

Posted by FragileFilter27 - Friday, November 23, 2007 5:59 AM

So I guess I should take Midway to court over Stranglehold because it locked up ONCE. So know what I did; I turned off my 360, waited a few seconds, turned it back on, waited untill I could play the game again, loaded the game, resumed from the last checkpoint before it locked up, and then proceded to beat the game a few ours latter with NO problem.
Also I never had a problem with H3 either.

Posted by Archonic20 - Friday, November 23, 2007 8:46 AM

The system freezes up because it overheats. If people would invest in the fan kits or just a normal fan to pull the heat away from the console, they would run better, and probably wouldn't melt.

Posted by CrispyDemon - Friday, November 23, 2007 12:29 PM

If your stupid enough to sue over something like this, your stupidity is probably what broke your xbox in the first place.

Posted by squeekyfoot - Friday, November 23, 2007 4:03 PM

I did have the same thing happen with Halo 3. It would lock up the 360 while still in the game menu. Didn't have an issue with other games though. Eventually it went from locking up to the red ring of death. Now initially Halo 3 worked fine because prior to this I played it enough to beat it twice. Could it be that one in a million chance that a poorly written piece of code in the game caused it, I don't know. It could have been the game and/or the console. Either way, I picked up a new Xbox and went back to playing Halo 3.

So, yes there is a chance that it was the game that caused the problem, but I doubt it.

Posted by mcp3 - Friday, November 23, 2007 5:15 PM

Wow microsoft, my 360 hasnt messed up "yet" but I do feel bad for those people whos did because at the end, all do respect it seems Microsoft's 360 sweat shops are scewing you and your fatefull fans over, dont make us buy a PAPER weight I mean a PS3.

Posted by torino_elite - Friday, November 23, 2007 5:23 PM

you know i spilled a beer on my carpet once while playing halo 3 and it did not freeze....damb you halo you owe me a free carpet and a newcastle ale.

Posted by autobotjazz_314 - Friday, November 23, 2007 6:15 PM

maybe the gamer is just a douche bag

or maybe every time that he got on he was stepping on the cord or sumthin

And 5 million dollars?!?!?! WTF?????????

Posted by TheKei - Friday, November 23, 2007 6:26 PM

It's hard for some 360 owners to comprehend that there are a ton of 360s failing. I know several people it has happened to. It shouldn't even be an issue. Nobody should need to buy a fan for their videogame system to function properly. Hopefully the new 360s they are shipping will have this issue corrected. It's ridiculous for this to go on for over two years. The guy in the story is an idiot, but someone needs to be held accountable for creating such a poorly made system anyway.

Posted by TheAwesomePS3 - Friday, November 23, 2007 7:50 PM

Did the guy try another game? Cause if the 360 was freezing, wouldn't it happen with anything else?

If I'm right, guy, you're a total retard!

Posted by mcp3 - Friday, November 23, 2007 10:31 PM

On a serious note I do know some people who 360s have redringed and Microsoft need to fix this retarded problem but this guy is a fu--ing retard how are gone sue because you cant play Halo 3 it aint that damn serious.

G4 PUT SOME NEW NEWS UP WHO CARES THIS HAS BEEN UP LIKE HALF A WEEK U GUYS JUST WANT PEOPLE TO ARGUE ABOUT HALO WHEN NOBODY CARES HALF THE PEOPLE ON MY FRIENDS LIST GOT ALL THE ACHIEVEMENTS AND MOVED ON TO COD 4

Posted by freeway8989 - Saturday, November 24, 2007 10:22 AM

The only problem Halo 3 has caused me is to feel bad when I lost to a n00b.

Posted by CPRxChris - Sunday, November 25, 2007 1:07 PM

It's because G4 is made up of a staff of Xbox Fanboys. And they REALLY like Halo, they even admitted that (jokingly and seriously). Notice, how whenever theres Xbox or Microsoft news, they keep it up for much longer than other pieces of information. AND, when theres a a preview for a game and it's multi-platform (let's just say PS3,360, and PC)they ALWAYS show a preview for the 360. And if its for PC, lets say Crysis, they sometimes show it, but then again, it is Microsoft(usually). But when it's, lets just say, PS3 or Wii, then rarely even report on it. Unless it's something REALLY big, like Metal Gear Solid 4, or Super Mario Galaxy.

Posted by kiohto - Sunday, November 25, 2007 1:45 PM

thats such bs, i never had my 360 lock up on Halo3 and Ive havent heard of that from a single one of my friends. its just winers trying to get money. very very rarely did I see the game lag up much less lock up a 360

Posted by thegame97338 - Sunday, November 25, 2007 2:31 PM

Thats funny, my PS3 works flawlessly. It's funny how people can still bad mouth the PS3 when the article is about the 360 failing again..

Posted by slobanocka - Sunday, November 25, 2007 3:20 PM

OMG.Is this guy an idiot.my 360 works just fine. But if one lags for a second people are suing for 5,000,000.

SERIOUSLY 5,000,000!

Posted by audallas84 - Sunday, November 25, 2007 8:33 PM

First off, RROD is not from playing a certain game, its a heat problem on certain motherboards. Any RROD that pops up during gameplay in merely coincedental.

Secondly CPRxChris, G4 (and every other gaming news source) reports 360 and Microsoft related news because that's whats actually going on. Don't blame G4 because Sony and the PS3 doesn't have anything going for it.

Posted by CPRxChris - Sunday, November 25, 2007 10:56 PM

Well audallas84, who said there's nothing going for Sony and PS3? They just might not report on it. And what about Nintendo and The Wii, nothing from them either? MS and Xbox outnumber the PS3,Sony,Wii,and Nintendo in news all of the time? That seems a little odd to me. And When they Have MS and Xbox news, like I said, they keep it up for much longer than really anything else.

Posted by freeway8989 - Sunday, November 25, 2007 11:30 PM

CPRxChris,

Well, I feel for you man. Despite being a 360 owner, I know it must suck for you to see all this MS news. I hate it when I go to Gizmodo and all the news they have is about how the iPhone got some stupid case mod. That site is BOOMING with Apple fanboys and Apple news. It's like every chance they get, they use to praise the iPhone. And although it may not seem bad at all to a fanboy, for someone, who doesn't like the company about which news is constantly posted, it SUCKS...HARD!

I'm with you. Although to me, it doesn't really seem bad that G4 posts all this MS news, I know how it feels to be on the other end. We should start a petition.

Plus, I wanna see some more MGS4 news.

That dick just wants quick cash...... and how dare he use halo's great name to achieve it

Posted by jonnyest09281988 - Monday, November 26, 2007 2:31 AM

my halo 3 shows no lag or crashes/freezes and i play it every day

Posted by bugman26 - Monday, November 26, 2007 7:56 AM

For the first time the past few days i played a ps3 and got to use its online. Simply not impressed. I know it's hardware is more reliable and that is nice. But so far my elite has caused me no problems. I was actually considering getting a ps3, but now i have no intention on gettin one anytime soon. PS3 boys "It's not that Great!". The interface sucks and nowhere near as user friendly as xbox. The funniest thing is that this christmas they were pushing it with free blu-ray movies. It is a v-i-d-e-o-g-a-m-e console. But considering it doesn't have anything to offer in that dept., they move it as a blu-ray player. That should kind of give you hint.

In know that it has "potential" but my brother shelled out 750 bucks for a 80 gig and all the accessories (another controller, a game, hdmi cord) and if i was him i would be severely dissapointed. Talk all U want as of right now the xbox ,gaming wise, is better!
